MABO360 provides digital tools that may include property discovery, property listings, saved properties, messaging, listing management, optional rental management, promotions, payments and other marketplace features made available from time to time.

Unless MABO360 expressly states otherwise for a specific service, MABO360 is a technology marketplace and is not a party to the sale, lease, tenancy, brokerage, agency, financing, valuation, conveyancing or other property transaction between users.

Features may differ by location, device, account status, availability or launch phase.

• “Account” means a registered MABO360 user account.
• “Listing” means a property advertisement or offer published or submitted through MABO360.
• “Lister” means any user who creates or manages a Listing, whether for the user’s own property or with authority from another person.
• “User” means any person who accesses or uses MABO360. MABO360 does not require separate normal-user categories such as seeker, owner or dalali; a registered user may use any normal marketplace functionality available to the account.
• “Managed Rental” means the optional private rental-management record a user creates for tracking a rental property, tenant and rent information.
• “Content” means text, photographs, videos, documents, messages, reviews, profile information, property information and other materials submitted to or displayed through MABO360.

You must be at least 18 years old and legally capable of entering into binding agreements to create an Account or use transaction-related features.

You are responsible for complying with laws and regulations that apply to you, your property, your advertising activities and any transaction you pursue.

If you use MABO360 on behalf of a company, partnership, property owner or other person, you represent that you have authority to do so and to bind that person where applicable.

You must provide accurate, current and complete information when registering and must keep it updated.

You are responsible for safeguarding passwords, one-time passwords, verification codes and devices used to access your Account.

You must notify us promptly at support@mabo360.co.tz if you suspect unauthorized access, account compromise or misuse.

We may require identity, phone, email or other verification where reasonably necessary for safety, fraud prevention, regulatory compliance or access to specific features.

You may request account closure through support@mabo360.co.tz. Closure does not automatically erase information we are required or permitted to retain.

MABO360 helps users discover and communicate about property opportunities. Users decide whether to contact each other, inspect property, negotiate, make payments, sign documents or complete a transaction.

You should independently verify property ownership, authority to advertise, property condition, location, boundaries, title or occupancy status, permits, charges, taxes, utilities, transaction documents, identity of counterparties and any other material fact before paying money or entering into an agreement.

MABO360 does not guarantee that a Listing is genuine, legally transferable, available, accurately priced, free from disputes or suitable for a particular purpose merely because it appears on the platform or has been reviewed by us.

Any verification, review, badge or moderation indicator means only what MABO360 expressly states it means. It is not a legal guarantee of ownership, title, transaction validity or counterparty performance.

Any registered user may create Listings where the feature is available. A user listing property for another person must have the property owner’s or other lawful controller’s permission to advertise it.

Each Listing must relate to the property or offer it describes. You must not knowingly create duplicate, bait, fake or misleading Listings.

You must provide information that is materially accurate, including the title, transaction type, price, location, availability, photos and key property characteristics.

For rental Listings, recurring price information must be represented accurately, including whether an amount is monthly or otherwise.

You must update, pause, mark as rented/sold, archive or remove a Listing when it is no longer available or when material information changes.

You are responsible for ensuring that photographs, documents and other materials you upload do not infringe another person’s privacy, copyright, trademark or other rights.

We may review, reject, delay, hide, suspend, edit for formatting, request changes to, or remove a Listing where we reasonably believe it violates these Terms, platform policies, law, safety requirements, another person’s rights or marketplace quality standards.

We may ask for evidence of identity, authority to advertise or property information before or after publication.

We are not required to pre-screen every Listing and publication does not mean that we endorse or warrant it.

Where a property owner, regulator, rights holder or other person makes a credible complaint, we may temporarily restrict a Listing while the matter is investigated.

MABO360 may provide messaging, phone-number display, WhatsApp links or other communication tools. When you contact another user, information you choose to share may be disclosed to that person.

You must use communication tools lawfully and respectfully and must not send spam, threats, harassment, fraudulent requests, malicious files or unlawful marketing.

Users are responsible for communications and agreements made outside MABO360, including through phone calls, WhatsApp, email or in-person meetings.

For safety, fraud prevention, moderation and service operation, MABO360 may retain platform messages and related metadata in accordance with the Privacy Policy and applicable law.

Rental Management is an optional private feature. Marking a Listing as rented does not automatically enroll the property into Rental Management unless the user chooses to do so.

A user may create a Managed Rental from an existing Listing or, where supported, create a private Managed Rental that was never publicly listed.

Initial Rental Management functionality may include property details, tenant name and contact information, monthly rent, due dates, manual payment records, payment history, tenancy end date and relisting.

MABO360 does not become a landlord, tenant, property manager, rent collector, trustee or party to the tenancy merely because the user records rental information in MABO360.

Users who enter tenant or other third-party personal data must have a lawful basis and appropriate authority to collect and enter that information, must provide any notices required by law, and must use the feature only for legitimate rental-management purposes.

Unless an integrated payment service is expressly enabled, “mark as paid” or similar functionality is only a record entered by the user and is not proof that MABO360 received, verified or transferred the underlying payment.

Browsing and other features may be free or paid depending on the configuration in effect at the time of use.

If MABO360 introduces subscriptions, promoted Listings, contact unlocks, payment processing or other paid services, the applicable price, duration, limits and payment terms will be shown before purchase.

Unless required by law or stated otherwise in a specific refund policy, fees for completed digital services or time-bound promotions may be non-refundable once performance has begun.

Taxes, mobile-money charges, bank charges or third-party payment fees may apply and will be handled as disclosed at checkout or by the relevant provider.

You retain ownership of Content you lawfully own. By uploading or publishing Content, you grant MABO360 a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, format, display, distribute and make the Content available as reasonably necessary to operate, secure, promote and improve MABO360 and to enable sharing of the Listing.

The licence continues for as long as reasonably necessary for the purposes above, including backups, legal records and previously generated sharing or audit records, subject to applicable law.

You represent that you have the rights and permissions necessary to provide the Content and grant this licence.

Where reviews or ratings are enabled, they must reflect genuine experience and must not be fabricated, manipulated, defamatory, abusive or submitted in exchange for improper incentives.

We may moderate, hide or remove reviews and reports that violate platform rules or law.

Users may report suspected fraud, misleading Listings, unavailable property, impersonation, intellectual-property infringement, abuse or other concerns through the reporting tools or support@mabo360.co.tz.

We may investigate reports and take action, but we do not guarantee a particular outcome or response time unless required by law.

You must not use MABO360 to:

• publish false, deceptive, fraudulent, unlawful, discriminatory, obscene, threatening or infringing content;
• advertise property without authority or impersonate another person or business;
• request money, passwords, verification codes or sensitive information through deception;
• scrape, harvest, crawl or systematically extract platform data except where expressly permitted;
• circumvent security, access controls, rate limits, moderation or payment controls;
• introduce malware, viruses, destructive code or denial-of-service attacks;
• reverse engineer, decompile or misuse platform software except to the extent such restriction is prohibited by law;
• use MABO360 to spam, harass, threaten or unlawfully market to other users;
• infringe intellectual-property, privacy, publicity or other legal rights;
• manipulate reviews, engagement, pricing, availability or search results;
• use information obtained through MABO360 for unlawful surveillance, discrimination, fraud or other prohibited purposes.

The MABO360 name, logo, software, design, databases, interface elements and original platform content are owned by or licensed to Mabo360 Ltd and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not copy, sell, license, commercially exploit, create competing databases from, or redistribute substantial portions of MABO360 content or software.

MABO360 may integrate with or link to third-party services such as maps, analytics, cloud hosting, authentication, payment providers, messaging platforms or external websites.

Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party content, availability, security or performance except to the extent required by law.

We may modify, add, remove, suspend or discontinue features to maintain, secure or improve MABO360 or to respond to legal, technical or business requirements.

We do not guarantee uninterrupted, error-free or virus-free operation. Planned or emergency maintenance, network failures, third-party outages and other events may make the platform temporarily unavailable.

We may impose reasonable technical limits, usage limits or anti-abuse controls.

To the maximum extent permitted by applicable law, MABO360 and its Content are provided on an “as is” and “as available” basis.

We do not warrant the accuracy, completeness, legality, availability, ownership, condition, value or suitability of any property or Listing, or the identity, authority, conduct, solvency or performance of any user.

Content on MABO360 is for marketplace information and does not constitute legal, financial, surveying, valuation, tax, investment or real-estate professional advice.

You are responsible for obtaining appropriate professional advice and conducting independent due diligence before entering into any property transaction.

To the fullest extent permitted by law, Mabo360 Ltd, its directors, employees and contractors will not be liable for indirect, consequential, special or punitive loss arising from use of MABO360, including loss of profits, opportunity, goodwill, data or anticipated savings.

We are not responsible for losses arising from user-to-user transactions, off-platform communications, inaccurate Listings, fraud by third parties, failed negotiations, deposits or payments made directly to another user, property defects, title disputes or actions of third-party providers.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold Mabo360 Ltd and its officers, employees and contractors harmless from third-party claims, losses and reasonable costs arising from your unlawful use of MABO360, your Listing or Content, your breach of these Terms, your infringement of another person’s rights, or a property transaction for which you are responsible.

We may warn, restrict, suspend or terminate an Account or specific feature access where we reasonably believe there is fraud, abuse, serious policy breach, legal risk, security risk, repeated complaints, non-payment of applicable fees or other conduct harmful to users or the platform.

Where appropriate and lawful, we may give notice or an opportunity to remedy a breach. Serious, urgent or unlawful conduct may result in immediate action.

On termination or account closure, public Listings may be removed and access to private features may cease. Certain records may be retained in accordance with the Privacy Policy and applicable law.

Our collection and processing of personal data is governed by the MABO360 Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

You must not upload another person’s identification, contact information, tenant information or other personal data unless you have authority and a lawful reason to do so.

You agree that MABO360 may provide service-related communications electronically through the platform, email, SMS, push notification, WhatsApp or phone where appropriate and permitted by law.

Marketing communications will be handled in accordance with the Privacy Policy and applicable consent or opt-out requirements.

We may update these Terms to reflect changes to MABO360, law, security, business practices or user protections.

We will publish the revised Terms and update the effective date. Where a change is material, we may provide additional notice through the platform or registered contact details.

Continued use after the revised Terms take effect constitutes acceptance to the extent permitted by law. If you do not accept a material change, you should stop using the affected service and may request account closure.

These Terms are governed by the laws of the United Republic of Tanzania, without prejudice to any mandatory rights that apply to you.

Users should first contact support@mabo360.co.tz to attempt to resolve a complaint or dispute. If it cannot be resolved, the dispute may be submitted to a court of competent jurisdiction in Tanzania or another forum required by applicable law.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.

These Terms, the Privacy Policy and any additional terms expressly presented for a specific paid or specialized service constitute the agreement governing use of MABO360 for that service.

MABO360 may provide these Terms in English and Kiswahili. The English version controls if there is a conflict.
